The Canadian government has updated the eligibility criteria for Spousal Open Work Permits (SOWPs), with new rules in effect from January 21. Now, spouses of foreign workers can only qualify for SOWPs if the foreign worker is employed in:
- TEER 0 (highest skill level) occupations.
- TEER 1 occupations.
- Select TEER 2 and TEER 3 occupations.
For eligibility, the foreign worker’s permit must also have at least 16 months of validity remaining at the time of the spouse’s application.
While these changes restrict eligibility, existing valid SOWPs and renewals under previous rules remain unaffected. Prior to this update, SOWPs were available regardless of the foreign worker’s occupation.
TEER, which stands for Training, Education, Experience, and Responsibilities, classifies jobs under the National Occupation Classification (NOC) system. TEER 2 and 3 occupations offer a pathway to SOWPs, making it vital for applicants to review the updated list of qualifying jobs.
